Title IX

What is Title IX?

Title IX is federal legislation that prohibits discrimination on the basis of sex and gender in education programs, including athletic programs or activities that receive federal funding. Under Title IX, discrimination on the basis of sex or gender can include sexual harassment and interpersonal violence including: stalking, relationship violence and sexual violence or misconduct.

The Title IX Coordinator and Title IX staff are here to aid students and employees with issues related to discrimination and harassment. While Title IX legislation is specific to sex or gender based harassment and violence, at Stritch, the Title IX staff addresses all forms of discrimination and harassment. Incidents of harassment and/or discrimination (of any and all types) should be promptly reported to the Title IX Coordinator:

Commitment to Nondiscrimination

Cardinal Stritch University, in accordance with applicable provisions of federal law, does not discriminate on grounds of race, religion, color, national origin, sex, age, sexual orientation, creed or handicap in the administration of any of its educational programs or activities, including admission or with respect to employment.

Nondiscrimination/Harassment Policy

It is the policy of this University to foster a community free from harassment and intimidation. Students and employees are expected to conduct themselves in a respectful manner at all times. Incidents of harassment will not be tolerated and should be promptly reported to a University official. Harassment refers to behavior that is unwelcome and personally offensive to its recipients. There shall be no harassment on the basis of a student's or employee's race, color, national origin, ancestry, religion, age, gender, marital status, medical condition, sexual orientation or physical or mental disability. Prohibited harassment includes but is not Limited to comments slurs, jokes, innuendos, cartoons, pranks or physical harassment. Harassment also includes negative actions based upon a student's or employee's participation in activities identified with any group. In order to promote a non-discriminatory, inclusive environment, our University will support programs to educate its community in regard to respect for all its members. Discrimination is defined as disparate treatment that unreasonably limits or denies access to, and benefits of, education, educational resources, co-curricular opportunities, housing or employment on the basis of race, color national origin, ancestry, religion, age, gender, marital status, medical condition, sexual orientation or physical or mental disability. There shall be no harassment of a student or employee that is prompted by interpersonal conflict, race, color, national origin, ancestry, religion, age, gender, marital status, medical condition, sexual orientation, physical or mental disability or any other reason. In particular, sexual harassment and sexual misconduct are violations of federal statute Title VII of the Civil Rights act of 1964 and Title IX of the 1972 Education Amendments (more information can be found in the Sexual Harassment and Misconduct Policy).

Sexual Misconduct and Harassment Policy

Consistent with the mission and Franciscan values of Cardinal Stritch University to provide a working and learning environment that fosters the intellectual, spiritual and social development of the individual, sexual harassment and sexual misconduct (which can include sexual violence, relationship violence and stalking) will not be tolerated and every effort will be made to eradicate it completely and swiftly. Cardinal Stritch University strives to prevent incidents of sexual harassment and sexual misconduct by providing education to its students and employees intended to promote awareness, provide options or bystander intervention, and educate victims regarding their rights and support systems as well as general risk reduction strategies. The University makes this education available to both new and returning students and employees through a variety of methods including: printed material, online resources, online learning modules, orientation activities and University-wide initiatives and events. However, in the event that sexual harassment and/or sexual misconduct occurs, the University has policies and procedures intended to aid the Stritch community in identifying incidents of sexual misconduct, articulating the rights of and supports available to both the victim and the accused in such situations, as well as to articulate the process and standard of evidence that will be used by the institution to investigate, make a determination, and offer sanctions(s) and/or resolution(s). Reporting and Resources for Survivors or Harassment or Interpersonal Violence

There are numerous options for reporting incidents of harassment or interpersonal violence as well as resources available to support survivors. If you, or someone you know, has experienced interpersonal violence, please consider contacting one of the resources below. In addition, retaliation against anyone who reports is strictly prohibited and reports of retaliatory behavior will be addressed immediately.

  • Responsible for all criminal investigations or on-campus crime.
  • For off campus crimes, state or local police are responsible for investigations.

Title IX Coordinator (Donney Moroney):  Investigates University conduct code and policy violations when the accused individual is a Stritch student or employee. Investigates regardless of whether the incident occurred on or off campus. Students and employees who violate University policies and conduct codes may be subject to discipline up to and including expulsion and/or termination.

CONFIDENTIAL REPORTING AND RESOURCES

Counseling Services: BH2113, (414) 410-4194: Provide immediate crisis intervention and therapy for recent or past victims.

Health Services: CH127, (414) 410-4097: Provide crisis and follow-up care for victims including free medical examinations, medications and STD testing. Assistance arranging referral services for evidence collection and crisis counseling.

University Ministry: CC121, (414) 410-4722: Provide personal and spiritual counseling and guidance. Assistance arranging referral services.

NON-CONFIDENTIAL REPORTING AND RESOURCES

All Stritch employees (other than those identified above as confidential reporters) are considered "Responsible Employees" and can take a report of a Title IX violation. It is important to note that while responsible employees will keep conversations private, only a conversation with a confidential resource can be kept confidential. All other reports will be shared with the Title IX Coordinator.

Pregnancy and Parenting

Cardinal Stritch University does not discriminate against any student on the basis of pregnancy, parenting or related conditions. The University is committed to supporting the letter and spirit of Title IX of the Education Amendments of 1972 (June 2013). Documented absences due to medical conditions related to pregnancy or parenting will be excused for as long as deemed necessary and educationally practicable. If a Leave of Absence is necessitated, the student will be reinstated at the same status held previous to the leave.

Student Affairs will assist in determining if any official accommodations need to be recommended to ensure equal access to the educational environment. Detailed documentation from the pregnant students' primary health care provider is essential to provide reasonable accommodations. The documentation should include a description of the student's functional limitations as a result of the condition and recommendations for detail with the condition's impact on the student's physical activities (such as necessary time away from class, clinicals, or labs) and academic activities (class notes, extended time, or alternative path to completion).
